By visiting this website or purchasing from us, you agree to these Terms and Conditions, our Shipping & Returns policy and our Privacy Policy, which form the full agreement between you and us. If you do not agree, please do not use this website.
Eligibility and use of the website
- You must be at least the age of majority in your province of residence to place an order.
- You agree not to use this website for any unlawful purpose, to transmit harmful code, to interfere with its security, or to copy, scrape or resell its content.
- We may refuse service to anyone, limit quantities, or cancel orders that appear to be placed by dealers, resellers or distributors, or that we reasonably suspect to be fraudulent.
Products, descriptions and images
We make every effort to describe and display our products accurately. Many pieces are supplied to order by our trusted suppliers. Colours, finishes and sizes may vary slightly from the images shown, and natural stones and handmade pieces can differ from photographs. Weights and measurements are approximate unless a certificate states otherwise.
Prices and pricing errors
- Prices are shown in Canadian dollars and exclude sales tax, which is calculated at checkout. Shipping within Canada is free.
- Prices of jewellery and precious metals can change at any time, including with the metals market and our suppliers’ prices, and may change without notice.
- If an item is listed at an incorrect price or with incorrect information because of an error, we may cancel the order and refund any amount paid, even after you have received an order confirmation, or offer you the item at the correct price.
Orders, acceptance and payment
- An order placed on this website is an offer to purchase. It is accepted only when we confirm it by email after verifying the final price, availability and receipt of your full payment.
- We accept Interac e-Transfer only, sent to info@nouras.ca. Payment is due within 48 hours of placing the order; unpaid orders are cancelled.
- If the price or availability of an item changes before acceptance, we will contact you and you may approve the change or cancel for a full refund of any amount paid.
- Title to the goods passes to you when we accept your order and receive full payment. Risk of loss passes to you on delivery or pickup.
Shipping, pickup, returns and cancellations
Shipping, pickup, returns, final sale items, restocking fees, cancellations and refunds are governed by our Shipping & Returns policy, which forms part of these Terms.
Custom work, repairs and services
Custom designs, special orders, resizing, engraving and other services are quoted individually. Custom and special-order work requires your written approval of the design, specifications and price before work begins and is final sale. Any deposit paid for custom work is non-refundable once we have ordered materials or started work.
Accuracy of your information
You agree to provide current, complete and accurate purchase and contact information, and to promptly update your email address and other details so that we can complete your transactions and contact you as needed.
Third-party services and links
This website may include tools, content or links provided by third parties, such as maps, payment services, analytics and social media. We do not control and are not responsible for third-party websites or services; your use of them is at your own risk and subject to their own terms.
Reviews and submissions
If you send us comments, reviews, ideas or other materials, you grant us the right to use, edit and publish them in any medium without compensation. You agree that your submissions will not be unlawful, misleading or offensive, and will not infringe the rights of any third party.
Intellectual property
All content on this website, including text, images, logos, designs and graphics, belongs to Noura’s Jewellery or its licensors and may not be copied or used without our written permission.
Disclaimer and limitation of liability
This website and its content are provided “as is” and “as available”. Gold and silver prices, calculators, estimates and guides on this website are for general information only and are not a binding offer to buy or sell. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, loss of profits or loss of data, and our total liability for any claim relating to a product or service is limited to the price you paid for that product or service. Nothing in these Terms excludes or limits any right you have under applicable consumer protection law that cannot be excluded or limited.
Indemnification
You agree to indemnify and hold harmless Noura’s Jewellery, its owners, employees and suppliers from any claim or demand arising from your breach of these Terms or your violation of any law or the rights of a third party.
Severability and entire agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of that right. These Terms, together with the policies referred to above, are the entire agreement between you and us regarding this website and your purchases.
Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. You agree to the jurisdiction of the courts of Ottawa, Ontario, subject to any rights you have under applicable consumer protection law.
